Abstract

The imperfections of the language of criminal procedure law and defects in legal technique generate problems in the application of criminal procedure norms. These issues stem from the imperfect linguistic expression of behavioral rules for investigators, inquiry officers, prosecutors, and judges. The ambiguity and polysemy of criminal justice terminology allow for different interpretations of legal norms even within a single proceeding, leading to inconsistent law enforcement across the country and varying approaches to similar phenomena by different criminal procedure actors. This ambiguity negatively affects the quality of criminal procedure activities, the stability of decisions made, and ultimately, the credibility of preliminary investigation bodies, prosecutor's office, and courts, as well as public trust in the fairness of
their decisions. The aim of the work is to substantiate the necessity of improving the language of criminal procedure law and eliminating linguistic defects of the law as conditions for ensuring the legality of criminal procedure activities and the stability of procedural decisions, including final judgments. The study is based on formal-logical, systemic-structural, and linguistic analysis of Criminal Procedure Code of the Russian Federation (CPC RF) norms. The research material includes texts of criminal procedure law regulating conceptual framework, termination of criminal cases, pre-trial proceedings, and special proceedings. The analysis aims to identify linguistic defects of the law that hinder the uniform interpretation of legal norms.
