Since a significant number of issues concerning the legal status of diplomats are determined domestically by each state independently, the problem of the lack of a uniform practice of bringing diplomatic employees to the responsibility for the prohibited items importation arises. The paper presents a study of the problems of the admissibility of the firearms importation into the territory of a foreign state by certain categories of inviolable persons. The authors focus attention on various approaches to understanding the essence of state sovereignty. The paper considers the experience of foreign states in regulating the procedure for importing, storing and carrying weapons by foreign citizens. Particular attention is paid to legal regulation in the territory of the United States, where, despite the pure and simple weapon import ban for private citizens, in the case of the weapon import by security guards of diplomatic missions, an exception with prior approval is possible. The paper provides the information on the legal regulation of this issue within the territory of the Russian Federation. The provisions of the Federal Law “On Weapons” are analyzed, according to which foreign citizens, including diplomatic representatives, do not have the right to store, carry and use firearms in the territory of the Russian Federation on a long-term basis. The authors formulate the conclusion about the necessity of supplementing the Vienna Convention of 1961 with a provision on the procedure for the movement of firearms across customs borders for heads of diplomatic missions and consular institutions, members of the diplomatic staff of diplomatic missions, consular officials, as well as members of their families.</p></abstract><trans-abstract xml:lang="ru"><p>В настоящее время не существует единых, унифицированных на международном уровне правил ввоза дипломатами оружия на территорию государства пребывания. В силу того, что значительный пласт вопросов правового статуса дипломатов определяется на внутригосударственном уровне каждым государством самостоятельно, возникает проблема отсутствия единой практики привлечения дипломатических сотрудников к ответственности за ввоз запрещенных предметов. В статье представлено исследование проблем допустимости ввоза огнестрельного оружия на территорию иностранного государства отдельными категориями лиц, обладающими дипломатической неприкосновенностью. Акцентируется внимание на различных подходах к пониманию сущности суверенитета государства. Рассматривается опыт иностранных государств по регламентации порядка ввоза, хранения и ношения оружия иностранными гражданами. Особое внимание уделено правовому регулированию на территории США, где, несмотря на однозначный запрет на ввоз оружия для частных лиц, в случае ввоза оружия охраной дипломатических представительств возможно исключение по предварительному согласованию. Приводятся сведения о правовом регулировании данного вопроса на территории Российской Федерации. Проанализированы положения Федерального закона «Об оружии», в соответствии с которыми иностранные граждане, в том числе дипломатические представители, не вправе хранить, носить и использовать огнестрельное оружие на территории Российской Федерации на длительной основе.<italic> </italic>Сформулирован вывод о необходимости дополнения Венской конвенции 1961 г. положением о порядке перемещения огнестрельного оружия через таможенные границы для глав дипломатических представительств, консульских учреждений, членов дипломатического персонала дипломатических представительств, консульских должностных лиц, а также членов их семей.</p></trans-abstract><kwd-group xml:lang="en"><kwd>diplomatic immunities</kwd><kwd>firearms</kwd><kwd>weapon importation</kwd><kwd>customs border crossing for selective types of goods</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>дипломатические иммунитеты</kwd><kwd>огнестрельное оружие</kwd><kwd>ввоз оружия</kwd><kwd>пересечение таможенных границ для отдельных видов товаров</kwd></kwd-group><funding-group/></article-meta></front><body></body><back><ref-list><ref id="B1"><label>1.</label><citation-alternatives><mixed-citation xml:lang="en">1.
